DA Exemption for Our 6m x 3m (18m²) Deck Pod At SCS Australia, our 6m x 3m (18m²) Deck Pod is fully exempt from Development Approval (DA) under NSW planning legislation. This exemption falls under Subdivision 9 of the State Environmental Planning Policy (SEPP) (Exempt and Complying Development Codes) 2008, which covers cabanas, gazebos, and similar non-habitable structures. Why is Our Deck Pod DA-Exempt?
- Size Compliance: Our 18m² footprint is well within the 20m² limit for most zones.
- Height Compliance: At a maximum height of 3m, it meets legal requirements.
- Boundary Setbacks: Can be installed 900mm from the boundary (or 5m in rural zones).
- Non-Habitable Class 10 Building: Designed as an outdoor deck, not a living space.
- Not a Shipping Container: Fully compliant under Clause 2.18(f).
- No Water or Sewer Connection: Aligns with Clause 2.18(n) for cabanas.
