These Terms and Conditions of Sale (“Terms”) govern all present and future sales of containers, equipment and accessories (“Equipment”), and any delivery or carriage services (“Carriage”) supplied by Shipping Container Services Australia Pty Ltd (ABN 90 663 037 447) (“we”, “us”, or “our”) to you (“you” or “Customer”).
By accepting a quotation, placing an order, or otherwise purchasing from us, you agree to be bound by these Terms.
A quotation issued by us (“Quote”) forms part of these Terms and must be read in conjunction with them. Quotes may include additional special conditions which will apply where specified. We reserve the right to refuse supply at our discretion.
1. Payment Terms
You agree to pay the price specified in the Quote, plus GST and any applicable charges (“Purchase Price”), in accordance with the payment terms specified by us.
1.1 Custom Builds & Factory Orders
A deposit of 50% is required for all custom builds and factory orders.
Orders will not be placed until 48 hours after Quote approval, allowing for a cooling-off period, unless waived by written agreement.
1.2 In-Stock Items
Full payment is required prior to delivery unless otherwise agreed in writing.
1.3 Payment Methods
Payment may be made via bank transfer, EFT, credit card, or any other method approved by us in writing.
2. Late Payments
If payment is not made by the due date, interest will accrue on the overdue amount at a rate of 25% per annum, calculated monthly, from the due date until payment is received in full.
3. Risk and Use
3.1 Risk
Risk in the Equipment passes to you upon delivery to you, your agent, or nominated carrier.
3.2 Use
You must ensure the Equipment is used safely and in compliance with all applicable laws, regulations, standards, and codes.
4. Supply-Only Basis
4.1 Supply Only
All Equipment is supplied on a supply-only basis unless otherwise agreed in writing.
4.2 Installation & Connections
Any installation, joining, or connection works are the responsibility of the Customer.
4.3 Site Works
You are responsible for all civil and site works, including (but not limited to):
- Electrical connections
- Water and waste connections
- Foundations and site preparation
5. Delivery Conditions
5.1 Site Access
You must ensure the delivery site is safe, accessible, and suitable for delivery.
5.2 Site & Weather Limitations
Delivery may be impacted by site conditions or weather. Alternative arrangements may be required.
5.3 Delivery Responsibility
We are not liable for delays, losses, or damages arising from delivery once Equipment has been dispatched to our carriers or agents.
5.4 Delivery Timing
All delivery times are estimates only. We are not liable for delays.
5.5 Placement of Equipment
Delivery agents will attempt placement as requested but may place Equipment in the nearest safe location if conditions are unsuitable.
5.6 Crane Requirements
If a crane is required, it is your responsibility to arrange and coordinate this in advance.
5.7 Cancellation of Delivery
If delivery is cancelled within 48 hours, a fee of 20% of the delivery charge will apply.
6. Council Approvals & Compliance
You are solely responsible for:
- Obtaining all required approvals, permits, and consents
- Ensuring compliance with local, state, and federal regulations
We do not provide advice or assistance regarding regulatory approvals.
7. Variations
Any variation requested after production has commenced may incur a 5% surcharge on affected items.
All variation requests must be submitted in writing and are subject to our approval.
8. Cancellation & Refund Policy
8.1 Cooling-Off Period
You may cancel your order within 48 hours of deposit payment for a full refund.
Cancellation must be submitted in writing.
8.2 Post Cooling-Off Cancellations
For custom builds and imported orders:
- Consignment Option:
The completed unit may be sold on consignment, with the deposit refunded once sold. - Immediate Cancellation Option:
A refund may be issued subject to a 10% deduction of total build cost.
8.3 Refund Processing
Approved refunds will be processed within 14 business days and returned via the original payment method unless otherwise agreed.
8.4 Non-Refundable Costs
Any costs already incurred (including delivery, permits, or additional services) are non-refundable.
9. Warranties
9.1 General Warranty
Equipment is covered by a 12-month limited warranty from delivery, in addition to your rights under Australian Consumer Law.
9.2 Manufacturer Warranties
All applicable manufacturer warranties (e.g. electrical components) are passed on to you.
9.3 Exclusions
The warranty does not cover:
- Misuse or improper installation
- Unauthorised modifications
- Minor cosmetic imperfections (including dents or scratches from transport)
10. Scope of Responsibility
We act solely as a supplier of Equipment and accept no responsibility for installation or related issues.
We strongly recommend engaging qualified professionals for installation and setup.
11. Acceptance of Terms
By accepting a Quote, placing an order, or purchasing from us, you acknowledge that you have read, understood, and agree to be bound by these Terms.
